De EU voedt ze."},"content":{"rendered":"<p><span style=\"font-weight: 400;\">OLAF, het antifraudebureau van de Europese Unie, heeft zojuist bekendgemaakt dat<\/span><a href=\"https:\/\/anti-fraud.ec.europa.eu\/media-corner\/news\/tobacco-olaf-joins-forces-dismantle-multimillion-euro-illicit-cigarette-supply-chain-2026-07-09_en\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">inbeslagname van illegale tabak<\/span><\/a><span style=\"font-weight: 400;\"> De waarde bedroeg meer dan 10 miljoen euro. 50 mensen werden gearresteerd. Dat is een overwinning op de georganiseerde misdaad, maar waarschijnlijk niet meer dan een druppel op een gloeiende plaat in de oceaan van illegale nicotineproducten.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OLAF-directeur-generaal Petr Klement zei: &quot;Roken is gevaarlijk, maar het roken van namaaksigaretten is nog veel erger. Naast de schade aan de gezondheid, berooft elke illegale sigaret de belastingbetaler en beloont het de georganiseerde misdaad. Daarom is OLAF er, om illegale handel op te sporen en bij te dragen met grensoverschrijdende inlichtingen en co\u00f6rdinatie.&quot; Onthoud dat even, meneer Klement. We komen er zo op terug.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Eerder dit jaar werd een onderzoek uitgevoerd door de <\/span><a href=\"https:\/\/www.scs.fraunhofer.de\/content\/dam\/scs\/DE\/download\/studien\/vaping-studie\/The%20irregular%20market%20for%20e-cigarettes%20in%20Europe_fin_EN.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Fraunhofer Instituut<\/span><\/a><span style=\"font-weight: 400;\"> Hetzelfde probleem deed zich ook voor op een andere markt. Dit is niet alleen een probleem met sigaretten. De zwarte markt voor e-sigaretten groeit net zo snel. Volgens het onderzoek wordt bijna de helft van alle e-sigaretten die in de EU worden gebruikt, illegaal verhandeld, met een waarde van ongeveer \u20ac 6,6 miljard. Als er niets verandert, kan dat cijfer in 2030 oplopen tot \u20ac 11 miljard.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Waar geld te verdienen valt, duiken altijd malafide personen op. De vraag is hoe je dat aanpakt.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Een van de opties is om strengere wetten in te voeren. Hogere boetes, gevangenisstraf voor smokkelaars en uiteindelijk het criminaliseren van de consument. Dit is wat sommige landen in de EU proberen, maar zonder succes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Nederland, een jaar na een verbod op smaakstoffen,<\/span><a href=\"https:\/\/www.brusselstimes.com\/2076002\/dutch-vape-flavour-ban-backfires-new-report-shows-rise-in-youth-use-illicit-trade-and-smoking\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">Het gebruik van e-sigaretten onder minderjarigen is meer dan verdubbeld.<\/span><\/a><span style=\"font-weight: 400;\">, Van 3,7 naar 7,6 procent. Het sigarettenverbruik nam toe. 27 procent van de voormalige vapers gaf aan meer te zijn gaan roken, of er weer mee te zijn begonnen, sinds het verbod van kracht is. Dat is het daadwerkelijke gezondheidsresultaat. Minder vapers, meer rokers, meer kinderen die vapen.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hoe kan dat? Omdat het verbod de producten niet heeft verwijderd. Het heeft ze alleen maar verplaatst. 42 procent van de gecontroleerde winkeliers voldeed niet aan de regels en 8 op de 10 consumenten gaven aan dat gearomatiseerde e-sigaretten nog steeds heel gemakkelijk te verkrijgen zijn. Waar komen ze vandaan? Van de zwarte markt, natuurlijk. De Nederlandse overheid voedt dus actief de zwarte markt met haar verboden, terwijl ze tegelijkertijd de volksgezondheid verslechtert.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Andere landen debatteren over soortgelijke verboden, en sommige hebben nicotinezakjes al aangepakt. Ze zijn volledig verboden in Belgi\u00eb, Nederland en, sinds april, in Frankrijk. Duitsland gaat dezelfde kant op met een de facto verbod op binnenlandse verkoop, hoewel persoonlijk gebruik legaal blijft. Frankrijk gaat het verst en criminaliseert de consument direct. Betrapt worden met een blikje nicotine kan leiden tot een boete en gevangenisstraf. De maximale straffen in de wet kunnen oplopen tot vijf jaar en 375.000 euro. Zal dit alles de vraag naar nicotine doen verdwijnen? Onwaarschijnlijk. Mensen grijpen al eeuwen naar nicotine, en geen enkele overheidsmaatregel zal die behoefte wegnemen. Het enige wat deze verboden dus bereiken, is dat ze de georganiseerde misdaad meer werk bezorgen.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dat brengt ons terug bij Petr Klement. De directeur-generaal van OLAF weet precies waar de illegale handel vandaan komt. Juist hij zou zich dus moeten uitspreken tegen meer verboden, in plaats van de inbeslagname toe te juichen die door die verboden onvermijdelijk wordt. Wat we in plaats daarvan nodig hebben, is verstandige, consumentvriendelijke regelgeving. Volwassenen zouden deze minder schadelijke alternatieven in gereguleerde winkels moeten kunnen kopen, niet in louche steegjes of vanuit de achterbak van iemands auto.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Het klinkt eenvoudig. Helaas lijkt de Europese Commissie dezelfde mislukte weg van verbod opnieuw te bewandelen. Updates van de Europese tabaksproductenrichtlijn en de accijnsrichtlijn liggen momenteel op tafel. En elk voorstel van de Commissie komt neer op dezelfde reflex: belast het tot de bodem, reguleer het tot de bodem, en als dat niet mogelijk is, verbied het dan helemaal. Als de Commissie haar zin krijgt, zullen de rookcijfers stijgen, omdat de toegang tot minder schadelijke alternatieven opdroogt, en zal er bovendien een bloeiende zwarte markt ontstaan.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Er is dus \u00e9\u00e9n ding om op te hopen. Dat OLAF ergens achter gesloten deuren de commissie laat weten dat het die extra werkzaamheden niet nodig heeft. Elk nieuw verbod is een cadeautje voor de smokkelaars die OLAF juist probeert te vervolgen.
