Wanneer de Europese Commissie spreekt over \u201c<\/span>Betere regelgeving<\/span><\/a>,Het belooft slimmere wetgeving, meer transparantie en een centrale rol voor burgers. In de praktijk ontdekken gewone mensen die de tijd nemen om deel te nemen aan EU-consultaties echter vaak iets heel anders: hun stemmen worden aan de kant geschoven, in diskrediet gebracht of simpelweg genegeerd. De World Vapers' Alliance (WVA) heeft zojuist gereageerd op de raadpleging van de Commissie. <\/span>oproep tot bewijs<\/span><\/a> In de richtlijnen voor betere regelgeving wordt een eenvoudige boodschap benadrukt: je kunt het geen "beter" noemen als je de mensen die de gevolgen ondervinden buitensluit.<\/span><\/p>\n

Burgers zijn geen nummers die je kunt afvinken.<\/b><\/p>\n

Als consumentenbeweging vertegenwoordigt WVA tienduizenden gebruikers van minder schadelijke nicotineproducten in heel Europa. Velen van hen zijn overgestapt van roken naar vapen of nicotinezakjes en willen dat hun ervaringen worden meegenomen in het EU-beleid. Ze reageren op consultaties, schrijven brieven aan hun Europarlementari\u00ebrs en nemen deel aan campagnes, omdat de EU burgers expliciet uitnodigt om mee te doen.<\/span><\/p>\n

Toch groeit het gevoel dat deze inspanningen als een formaliteit worden beschouwd. Openbare raadplegingen en oproepen tot het indienen van bewijsmateriaal worden te vaak behandeld als administratieve stappen om af te vinken, in plaats van als een oprechte poging om te horen wat burgers denken. Wanneer reacties overeenkomen met wat de commissie al wilde doen, worden ze verwelkomd als "steun". Wanneer ze dat niet doen, worden ze stilletjes terzijde geschoven of afgedaan als minder legitiem.<\/span><\/p>\n

Voor WVA is dit geen procedureel detail, maar een democratisch probleem. Als mensen tijd en energie investeren in participatie, om vervolgens te zien dat hun standpunten worden afgewezen omdat ze ongemakkelijk zijn, waarom zouden ze dan nog betrokken blijven? Een systeem van betere regelgeving dat burgers demotiveert, faalt in zijn meest fundamentele taak.<\/span><\/p>\n

Van consultatie tot definitieve goedkeuring<\/b><\/p>\n

Onze ervaring met tabaks- en nicotinebeleid laat zien hoe dit in de praktijk uitpakt. Consultaties, effectbeoordelingen en evaluatierapporten zijn verplichte stappen die de Europese Commissie moet doorlopen en die bedoeld zijn om beleidsopties vorm te geven. In plaats daarvan lijken ze vaak te worden opgesteld nadat de belangrijkste politieke beslissingen al zijn genomen en worden ze gebruikt om een gekozen koers te rechtvaardigen in plaats van deze ter discussie te stellen.<\/span><\/p>\n

In diverse dossiers over tabak en nicotine hebben burgers en consumentengroepen massaal gereageerd op strengere beperkingen voor minder schadelijke alternatieven zoals vapen en nicotinezakjes. In plaats van tot heroverweging aan te zetten, wordt dit verzet vaak weggewuifd: respondenten worden bestempeld als "aan de industrie gelieerd", nep of bots, hun ervaringen met stoppen met roken worden als anekdotisch beschouwd en de voorstellen worden grotendeels ongewijzigd doorgevoerd.\u00a0<\/span><\/p>\n

Het formele proces blijft bestaan, maar de essentie ervan is uitgehold. Wat een kompas zou moeten zijn, wordt een stempelmachine.<\/span><\/p>\n

Burgers zwartmaken om ze het zwijgen op te leggen.<\/b><\/p>\n

Een bijzonder zorgwekkende ontwikkeling is de manier waarop sommige actoren hebben geprobeerd hele groepen respondenten in diskrediet te brengen. Tijdens de consultatie over de tabaksbelastingrichtlijn gebruikten duizenden Europeanen offici\u00eble EU-kanalen om aan te geven dat hogere belastingen op veiligere nicotineproducten de volksgezondheid zouden schaden doordat mensen weer zouden overstappen op sigaretten of naar de illegale markt zouden vluchten. In plaats van serieus op deze argumenten in te gaan, ontstond echter het idee dat veel van deze reacties "nep", georkestreerd of onrechtmatig waren.<\/span><\/p>\n

A <\/span>Clearing the Air-onderzoek<\/span><\/a> Er werd onthuld hoe een weinig bekende ngo hielp dit verhaal te verspreiden, door gewone burgers af te schilderen als marionetten of "frontmannen van de industrie", simpelweg omdat ze zich verzetten tegen de koers van de Commissie. Deze lastercampagne beledigde niet alleen individuen; het bood een handig excuus om hun standpunten te negeren, en het lijkt erop dat de Europese Commissie erin trapt. Zodra mensen als marionetten kunnen worden bestempeld, hoef je niet meer te luisteren naar wat ze werkelijk te zeggen hebben.<\/span><\/p>\n

Wat betere regelgeving zou moeten betekenen<\/b><\/p>\n

In ons advies aan de Commissie betogen we dat de richtlijnen voor betere regelgeving teruggebracht moeten worden naar hun kerndoel: het EU-recht effectiever en democratischer maken. Dat vereist meer burgerparticipatie, niet minder.<\/span><\/p>\n

Voor vapers en gebruikers van andere nicotineproducten met een verlaagd risico hebben deze procedurele kwesties zeer re\u00eble gevolgen. Wanneer burgers worden uitgesloten, wordt het beleid rond vapen, pouches of heat-not-burn-producten gevormd door mensen die ze nooit hebben gebruikt \u2013 of die er ideologisch tegen zijn. Zo komen we terecht bij smaakverboden, buitensporige belastingen en beperkingen die de ervaringen negeren van miljoenen mensen die dankzij deze alternatieven zijn gestopt met roken.<\/span><\/p>\n

Maar dit gaat niet alleen over nicotine. Als publieke participatie op \u00e9\u00e9n gebied kan worden genegeerd, kan dat ook op andere gebieden. Vandaag gaat het misschien om schadebeperking; morgen om voedsel, alcohol, transport of digitale rechten. Een systeem van betere regelgeving dat instellingen in staat stelt te bepalen welke burgers meetellen, is gevaarlijk voor iedereen.<\/span><\/p>\n

De World Vapers' Alliance zal de stem van consumenten blijven versterken en hun recht verdedigen om gehoord te worden over beleid dat hun leven be\u00efnvloedt.
