{"id":5337,"date":"2024-01-14T06:28:56","date_gmt":"2024-01-14T11:28:56","guid":{"rendered":"https:\/\/worldvapersalliance.com\/?p=5337"},"modified":"2024-01-22T06:30:48","modified_gmt":"2024-01-22T11:30:48","slug":"mexicos-vape-ban-deemed-unconstitutional","status":"publish","type":"post","link":"https:\/\/worldvapersalliance.com\/nl_nl\/mexicos-vape-ban-deemed-unconstitutional\/","title":{"rendered":"Het Mexicaanse verbod op e-sigaretten wordt ongrondwettelijk verklaard."},"content":{"rendered":"<h4>Nu Zuid-Amerika steeds meer neigt naar een verbod, heeft de tweede kamer van het Mexicaanse Hooggerechtshof het lokale verbod op e-sigaretten ongrondwettelijk verklaard.<\/h4>\n<p><a href=\"https:\/\/www.vapingpost.com\/2023\/01\/21\/mexico-sets-in-place-new-strict-tobacco-regulations\/\">Mexico<\/a> De regering heeft nieuwe, strenge tabaksregelgeving ingevoerd als onderdeel van de hervorming van de Algemene Wet ter Bestrijding van Tabaksgebruik, met als doel roken terug te dringen en de volksgezondheid te bevorderen. De uitgebreide maatregelen bouwen voort op de bestaande federale en deelstaatwetten inzake tabaksbestrijding uit 2008 en omvatten een volledig verbod op de promotie, reclame en sponsoring van tabaksproducten.<\/p>\n<p>Met het bovenstaande zijn nieuwe regels met betrekking tot de verkoop en het gebruik van vapenproducten ingevoerd. Het Mexicaanse verbod op de verkoop van vapes is echter door het hoogste gerechtshof van het land, de Tweede Kamer van het Hooggerechtshof, met drie stemmen voor ongrondwettelijk verklaard.<\/p>\n<h5>Lokale verkopers van e-sigaretten kunnen het verbod aanvechten.<\/h5>\n<p>De uitspraak stelt dat het presidentieel decreet dat het verbod afdwingt de vrijheid van handel schendt, wat een juridische tegenslag betekent voor de poging van de regering om de verkoop van e-sigaretten in Mexico te beperken. Een deel van de uitspraak stelt echter dat het verbod in strijd is met de vrijheid van handel. <a href=\"https:\/\/www.scjn.gob.mx\/derechos-humanos\/sites\/default\/files\/sentencias-emblematicas\/summary\/2022-02\/Summary%20CT270-2016%20HRO.pdf\">een amparo-rechtszaak<\/a>, Deze uitspraak is specifiek van toepassing op de onderhavige zaak.
