De Tweede Kamer van het hof oordeelde met drie stemmen voor dat het decreet in strijd is met het recht op vrijheid van handel.<\/p>\n<p dir=\"ltr\">Alberto G\u00f3mez Hern\u00e1ndez, beleidsmanager van de World Vapers&#039; Alliance, gaf de volgende reactie:<\/p>\n<p dir=\"ltr\"><em>\u201cWij verwelkomen de uitspraak van het Nationale Hooggerechtshof. Het decreet schendt niet alleen het recht op vrije handel van bedrijven, maar ook het recht op gezondheid en de vrije ontwikkeling van de persoonlijkheid van volwassen Mexicanen. Mexicanen moeten zelf kunnen bepalen hoe ze nicotine consumeren.\u201d<\/em><\/p>\n<p dir=\"ltr\">De verklaring van ongrondwettelijkheid werd afgelegd in een amparo-rechtszaak \u2013 een type rechtszaak in Mexico waarmee een bedrijf juridische bescherming of toestemming kan vragen om zich niet te hoeven houden aan regelgeving die zijn rechten schendt. Het algemene verbod blijft van kracht, aangezien de uitspraak alleen van toepassing is op die specifieke zaak en dat specifieke bedrijf. Het toont echter wel aan dat zelfs de hoogste rechterlijke instantie van Mexico de ongrondwettelijkheid erkent.<\/p>\n<p dir=\"ltr\">Hierover voegde G\u00f3mez Hern\u00e1ndez toe:<\/p>\n<p dir=\"ltr\"><em>\u201c&quot;Hoewel de uitspraak geen rechtskracht heeft, hopen we dat de regering of de rechterlijke macht het verbod snel zal terugdraaien. Het verbod is mislukt, heeft het probleem van de volksgezondheid als gevolg van roken in Mexico verergerd en een enorme zwarte markt gecre\u00eberd die wordt gecontroleerd door de maffia.&quot;.<\/em><\/p>\n<p dir=\"ltr\"><strong>Roken veroorzaakt jaarlijks meer dan 40.000 doden in Mexico, waar nog steeds bijna 15 miljoen rokers zijn.<\/strong><\/p>\n<p dir=\"ltr\"><em>\u201c&quot;Mexico moet het verbod opheffen en een strategie hanteren die het gebruik van minder schadelijke nicotineproducten als hulpmiddel bij het stoppen met roken omvat.
