Het aanstaande allesomvattende begrotingsvoorstel van het Congres, waarover later deze week gestemd zal worden, zal een maatregel bevatten die de Amerikaanse Food and Drug Administration (FDA) de bevoegdheid geeft om synthetische nicotineproducten te reguleren als tabaksproducten.<\/h5>\n

Op 15 december heeft Mikie Sherrill, congreslid uit New Jersey, ge\u00efntroduceerd<\/a> De Clarifying Authority Over Nicotine Act van 2021, een wetsvoorstel met steun van beide partijen, geeft de Amerikaanse Food and Drug Administration (FDA) de bevoegdheid om synthetische nicotineproducten te reguleren, op dezelfde manier als nicotineproducten die van tabak zijn gemaakt of daarvan zijn afgeleid. De nieuwe wetgeving werd aangenomen op 15 maart en trad in werking op 14 april.<\/p>\n

In een persbericht<\/a>, Volgens afgevaardigde Sherrill is het wetsvoorstel bedoeld om minderjarigen te beschermen. "Dit wetsvoorstel zorgt ervoor dat alle tabaksproducten, inclusief producten met synthetische nicotine, worden gereguleerd door de FDA om kinderen in onze gemeenschappen en degenen die deze producten mogelijk willen gebruiken, te beschermen."\u201c<\/p>\n

Zoals de Federal Food, Drug, and Cosmetic Act (FDCA) er nu uitziet, definieert deze wet een \u201ctabaksproduct<\/a>\u201d"als elk product dat gemaakt is van of afgeleid is van tabak en bestemd is voor menselijke consumptie, inclusief elk bestanddeel, onderdeel of accessoire van een tabaksproduct." Naast het reguleren van synthetische nicotine als een "bestanddeel" van een tabaksproduct, zou de FDA het echter ook kunnen reguleren als een "geneesmiddel".<\/p>\n
