Dans les derni\u00e8res heures de la session du Comit\u00e9 \u00e9conomique et social europ\u00e9en (CESE)* consacr\u00e9e \u00e0 la directive sur les accises sur le tabac (DAT), une man\u0153uvre <\/span>\u00e9merg\u00e9<\/span><\/a> Cette d\u00e9cision a stup\u00e9fi\u00e9 les observateurs. Andris Gobi\u0146\u0161, d\u00e9put\u00e9 letton au CESE, a choisi la toute fin d'un long processus pour retirer 24 amendements qui auraient d\u00e9pouill\u00e9 le projet de toute dimension \u00e9conomique et de r\u00e9duction des risques.<\/span><\/p>\n

Ce timing soul\u00e8ve une question cruciale\u00a0: s\u2019agit-il d\u2019une v\u00e9ritable r\u00e9v\u00e9lation tardive ou d\u2019une strat\u00e9gie coordonn\u00e9e pour contourner un d\u00e9bat de fond\u00a0?<\/span><\/p>\n

Contester la r\u00e8gle 80% d'un brouillon en \u201c ne sachant rien \u201d<\/b><\/h4>\n

L'aspect le plus frappant de l'intervention de Gobi\u0146\u0161 r\u00e9side dans la contradiction de sa propre position. Gobi\u0146\u0161 aurait affirm\u00e9 n'avoir que peu de connaissances sp\u00e9cialis\u00e9es en mati\u00e8re de questions fiscales complexes et de r\u00e9duction des risques. Pourtant, malgr\u00e9 ce manque d'expertise reconnu, il a propos\u00e9 d'amender l'article 80% du projet.<\/span><\/p>\n

Ces amendements \u00e9limineraient syst\u00e9matiquement les pr\u00e9occupations relatives \u00e0 la proportionnalit\u00e9 et \u00e0 la viabilit\u00e9 \u00e9conomique de la r\u00e9forme fiscale (pr\u00e9occupations d\u00e9j\u00e0 soulev\u00e9es par de nombreux \u00c9tats membres et, dans bien des cas, d\u00e9j\u00e0 rejet\u00e9es par le Conseil). Au lieu de cela, ils entra\u00eeneraient une hausse des prix pour tous les produits, ignorant les avertissements concernant l'explosion du commerce illicite dans des r\u00e9gions comme la Lettonie, en se r\u00e9f\u00e9rant simplement aux \u201c\u00a0directives claires\u00a0\u201d de la Commission europ\u00e9enne. Une strat\u00e9gie pour faire d\u00e9railler ?<\/b><\/h4>\n

Pourquoi attendre la derni\u00e8re session pour introduire des changements aussi fondamentaux\u00a0? Dans le domaine politique europ\u00e9en, cette \u201c\u00a0d\u00e9mission de derni\u00e8re minute\u00a0\u201d est une tactique classique visant \u00e0 emp\u00eacher les parties prenantes d\u2019analyser ou de formuler des objections. Au moment o\u00f9 ces 24 propositions ont \u00e9t\u00e9 d\u00e9pos\u00e9es, la possibilit\u00e9 d\u2019un d\u00e9bat \u00e9quilibr\u00e9 \u00e9tait d\u00e9j\u00e0 d\u00e9finitivement \u00e9cart\u00e9e (le vote a lieu aujourd\u2019hui, le 18 f\u00e9vrier).<\/span><\/p>\n

Cette man\u0153uvre ressemble \u00e9trangement \u00e0 un \u201c plan B \u201d. Pendant des mois, la Commission europ\u00e9enne et ses ONG alli\u00e9es ont tent\u00e9 de faire d\u00e9railler le processus d\u00e9mocratique en s'attaquant \u00e0 la voix du peuple. Une enqu\u00eate men\u00e9e par <\/span>Purifier l'air<\/span><\/i> <\/a>L'organisation a r\u00e9cemment r\u00e9v\u00e9l\u00e9 comment une ONG financ\u00e9e par Bloomberg, appel\u00e9e Impact Unfiltered, s'est employ\u00e9e \u00e0 discr\u00e9diter 18\u00a0000 soumissions de consultation en les qualifiant de \u201c\u00a0fausses\u00a0\u201d ou de \u201c\u00a0contr\u00f4l\u00e9es par l'industrie du tabac\u00a0\u201d.<\/span><\/p>\n

Cette tentative a \u00e9chou\u00e9 lorsque l'analyse des donn\u00e9es a prouv\u00e9 que les soumissions provenaient de vraies personnes, des vapoteurs europ\u00e9ens, des utilisateurs de pochettes et des citoyens, et non de robots de l'industrie. N'ayant pas r\u00e9ussi \u00e0 discr\u00e9diter le <\/span>publique<\/span><\/i> De l'ext\u00e9rieur, il appara\u00eet que les alli\u00e9s id\u00e9ologiques de la Commission tentent d\u00e9sormais de radicaliser le projet de loi au sein d'autres institutions de l'UE, par l'interm\u00e9diaire de membres comme Gobi\u0146\u0161.<\/span><\/p>\n

Conclusion<\/b><\/h4>\n

Bien que le projet actuel soit d\u00e9j\u00e0 profond\u00e9ment imparfait, les amendements Gobi\u0146\u0161 l'aggraveraient consid\u00e9rablement en r\u00e9introduisant des mesures qui n'ont d\u00e9j\u00e0 pas obtenu le soutien du Conseil. Apr\u00e8s la d\u00e9nonciation de la campagne de diffamation contre les citoyens ordinaires, cette nouvelle tentative de faire d\u00e9railler le processus montre jusqu'o\u00f9 certains sont pr\u00eats \u00e0 aller pour bloquer les alternatives moins nocives au tabac.<\/span><\/p>\n

Le CESE est un organe consultatif o\u00f9 des groupes de travail compos\u00e9s d'ONG et de partenaires sociaux \u00e9laborent des avis formels afin de garantir que la voix de la soci\u00e9t\u00e9 civile soit entendue sur des textes l\u00e9gislatifs tels que la directive relative aux accises sur le tabac.
