Aucune distinction r\u00e9elle entre les produits, aucun d\u00e9bat s\u00e9rieux sur la r\u00e9glementation, juste une interdiction totale qui, dans les faits, n\u2019a absolument pas frein\u00e9 son utilisation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cette approche est aujourd&#039;hui remise en question.<\/span><\/p>\n<p><a href=\"https:\/\/www.cartacapital.com.br\/justica\/mpf-apresenta-acao-que-pode-derrubar-proibicao-total-de-cigarros-eletronicos-no-brasil\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Le parquet f\u00e9d\u00e9ral br\u00e9silien (MPF) a intent\u00e9 une action civile publique qui pourrait remplacer l&#039;interdiction totale des cigarettes \u00e9lectroniques dans le pays par un cadre r\u00e9glementaire strict. <\/span><\/a><span style=\"font-weight: 400;\">Et ce qui est frappant, ce n&#039;est pas seulement la d\u00e9marche juridique en elle-m\u00eame, c&#039;est la logique qui la sous-tend.<\/span><\/p>\n<h5><b>Un rare moment d&#039;honn\u00eatet\u00e9 dans les politiques de sant\u00e9 publique<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Le MPF reconna\u00eet ouvertement un point souvent ignor\u00e9 dans ces d\u00e9bats\u00a0: interdire un produit ne le fait pas dispara\u00eetre. Selon les procureurs, l\u2019interdiction cr\u00e9e un <\/span><i><span style=\"font-weight: 400;\">faux sentiment de s\u00e9curit\u00e9<\/span><\/i><span style=\"font-weight: 400;\"> tout en alimentant les march\u00e9s ill\u00e9gaux et les r\u00e9seaux de contrebande.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">UN <\/span><a href=\"https:\/\/sites.usp.br\/esem\/wp-content\/uploads\/sites\/1430\/2025\/10\/1o-Levantamento-Nacional-sobre-a-Demanda-de-Bens-e-Servicos-Ilicitos-no-Brasil_.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">\u00e9tude de l&#039;Universit\u00e9 de S\u00e3o Paulo<\/span><\/a><span style=\"font-weight: 400;\"> L&#039;USP (Office for National Statistics) indique que le Br\u00e9sil perd chaque ann\u00e9e 13,7 milliards de rands de recettes fiscales en raison du commerce ill\u00e9gal de cigarettes \u00e9lectroniques et de cigarettes de contrefa\u00e7on. L&#039;absence de r\u00e9glementation alimente le march\u00e9 noir, g\u00e9n\u00e9rant 7,81 milliards de rands de ventes non tax\u00e9es.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">C&#039;est important car, lorsque des produits sont vendus clandestinement, il n&#039;existe ni normes de qualit\u00e9, ni protections pour les consommateurs, ni informations fiables, ni v\u00e9ritable contr\u00f4le. Les gens continuent de les utiliser, mais sans r\u00e8gles, sans contr\u00f4le de qualit\u00e9 ni v\u00e9rification de l&#039;\u00e2ge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">C&#039;est exactement le contraire de la protection de la sant\u00e9 publique.<\/span><\/p>\n<h5><b>R\u00e9glementer ne signifie pas laisser-aller<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Ce qui est propos\u00e9 n&#039;est pas une situation de laisser-aller g\u00e9n\u00e9ralis\u00e9. Bien au contraire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le MPF r\u00e9clame un mod\u00e8le r\u00e9glementaire assorti de r\u00e8gles claires et strictes\u00a0: enregistrement obligatoire des produits, limitation des taux de nicotine, avertissements sanitaires explicites sur les emballages et interdiction totale de la publicit\u00e9 destin\u00e9e aux enfants et aux adolescents. Cette action exige \u00e9galement la transparence, notamment des donn\u00e9es d\u00e9taill\u00e9es sur la consommation et un calendrier pr\u00e9cis pour la mise en \u0153uvre.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reconna\u00eetre la r\u00e9alit\u00e9 et y r\u00e9pondre par le contr\u00f4le, l&#039;application des r\u00e8gles et la responsabilisation, voil\u00e0 \u00e0 quoi ressemble une r\u00e9glementation s\u00e9rieuse, et c&#039;est l&#039;approche que le Br\u00e9sil aurait d\u00fb adopter ces derni\u00e8res ann\u00e9es.<\/span><\/p>\n<h5><b>Pourquoi ce d\u00e9bat est important maintenant<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">L&#039;approche actuelle n&#039;a pas r\u00e9duit la demande ; au contraire, elle l&#039;a augment\u00e9e, le nombre d&#039;utilisateurs passant de 500 000 en 2018 \u00e0 plus de 2,8 millions en 2023. Elle a tout simplement livr\u00e9 le march\u00e9 \u00e0 l&#039;ill\u00e9galit\u00e9.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Un cadre r\u00e9glementaire, en revanche, cr\u00e9e les conditions n\u00e9cessaires \u00e0 la surveillance, \u00e0 la protection des consommateurs et \u00e0 l&#039;\u00e9laboration de politiques fond\u00e9es sur des donn\u00e9es probantes. Bien s\u00fbr, cette action en justice ne r\u00e9sout pas tout du jour au lendemain. Mais elle ouvre la voie \u00e0 un dialogue plus franc et plus constructif sur le fonctionnement optimal des politiques de sant\u00e9 publique.<\/span><\/p>\n<h5><b>Il faut prioriser les preuves<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">La sant\u00e9 publique est plus efficace lorsqu&#039;elle repose sur des faits. Le Br\u00e9sil a aujourd&#039;hui l&#039;opportunit\u00e9 de passer d&#039;interdictions symboliques \u00e0 une approche r\u00e9glementaire qui prenne en compte la complexit\u00e9 du probl\u00e8me, privil\u00e9gie la s\u00e9curit\u00e9 et assume la responsabilit\u00e9 des cons\u00e9quences concr\u00e8tes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reste \u00e0 savoir si les d\u00e9cideurs politiques sont pr\u00eats \u00e0 franchir ce pas.
