Taxing harm reduction tools like vaping <\/span><b>only benefits cigarette sales<\/b><span style=\"font-weight: 400;\">, which remain widely available.<\/span><\/p>\n<ol start=\"3\">\n<li><b> PMTA Registries &amp; Overregulation \u2013 A Backdoor Ban<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Some states are proposing <\/span><b>PMTA registry requirements<\/b><span style=\"font-weight: 400;\">, which would limit the sale of vapor products to <\/span><b>only those that have received full FDA marketing approval<\/b><span style=\"font-weight: 400;\">\u2014a nearly impossible hurdle for most small and independent vape manufacturers.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=1534&amp;Year=2025&amp;Initiative=False\" target=\"_blank\" rel=\"noopener\"><b>Washington (HB 1534)<\/b><\/a><span style=\"font-weight: 400;\"> \u2013 Introduces a <\/span><b>PMTA registry system<\/b><span style=\"font-weight: 400;\">, which could <\/span><b>effectively ban most vaping products<\/b><span style=\"font-weight: 400;\"> by limiting sales to FDA-authorized items (of which there are very few).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB276&amp;year=2025&amp;code=R\" target=\"_blank\" rel=\"noopener\"><b>Missouri (HB 276)<\/b><\/a><span style=\"font-weight: 400;\"> \u2013 Requires manufacturers to have received a <\/span><b>marketing granted order from the FDA<\/b><span style=\"font-weight: 400;\"> or certify that their product was on the market before <\/span><b>August 8, 2016<\/b><span style=\"font-weight: 400;\">, and has a pending PMTA\u2014severely restricting product availability.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">These bills are <\/span><b>not about consumer safety<\/b><span style=\"font-weight: 400;\">; they are <\/span><b>thinly veiled attempts to remove most vapor products from the market<\/b><span style=\"font-weight: 400;\">, forcing vapers back to combustible cigarettes or unreliable black-market alternatives.<\/span><\/p>\n<h4><b>Who Wins from These Laws?<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">It\u2019s certainly <\/span><b>not adult smokers looking to quit<\/b><span style=\"font-weight: 400;\">. Instead, these policies benefit:<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u2705<\/span> <b>Big Tobacco<\/b><span style=\"font-weight: 400;\">, which will continue selling deadly combustible cigarettes while safer alternatives are taxed or banned.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u2705<\/span> <b>Illicit Market Sellers<\/b><span style=\"font-weight: 400;\">, as consumers seek unregulated and potentially dangerous products.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u2705<\/span> <b>State Governments<\/b><span style=\"font-weight: 400;\">, which collect billions in cigarette tax revenue and often have financial incentives to keep people smoking.<\/span><\/p>\n<h4><b>What Can You Do?<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Vapers and harm reduction advocates <\/span><b>must take action<\/b><span style=\"font-weight: 400;\"> before it\u2019s too late.
