EU Health Commissioner Oliv\u00e9r V\u00e1rhelyi posted an update on <\/span>LinkedIn<\/span><\/a> this week under the headline <\/span>\u201cNew products, new risks: Europe\u2019s tobacco rules must be fit for the future,\u201d<\/span><\/i> framing Brussels\u2019 next move on tobacco and nicotine policy as protection for young people. In it, he claims the EU\u2019s goal is a \u201c<\/span>tobacco and nicotine-free generation by 2040,\u201d<\/span><\/i> and that the European Commission is <\/span>\u201cconsulting widely\u201d<\/span><\/i> so citizens can have their say on the future of tobacco control.\u00a0<\/span><\/p>\n

Both claims are false, and both serve the same purpose: strengthening a narrative that lets the Commission justify restrictions on less harmful nicotine products it has been trying to impose for years.<\/span><\/p>\n

The goal was never nicotine-free<\/b><\/h4>\n

V\u00e1rhelyi wrote: <\/span>\u201cOur goal remains clear: a tobacco and nicotine-free generation by 2040.\u201d<\/span><\/i> Two paragraphs later, in the same post, one of his own bullet points describes the Commission\u2019s plan as moving <\/span>\u201ccloser to a tobacco-free generation by 2040\u201d<\/span><\/i>. If the goal was as clear as claimed, it wouldn\u2019t need two different names in one LinkedIn post.<\/span><\/p>\n

The real mandate comes from <\/span>Europe\u2019s Beating Cancer Plan<\/span><\/a>, adopted in 2021. It set a target of a tobacco-free generation by 2040, defined as under 5% of the population using tobacco products. Nicotine was never written into that target, for a simple reason: nicotine on its own doesn\u2019t kill people, combustion does. Specifically, the combustion of tobacco in cigarettes, which produces the tar and toxicants behind most smoking-related diseases. Less harmful nicotine products break that link in different ways: heat-not-burn devices contain tobacco but don\u2019t burn it, so they don\u2019t produce smoke; vapes and nicotine pouches don\u2019t contain tobacco or produce smoke at all. That\u2019s the entire premise behind harm reduction.<\/span><\/p>\n

It was V\u00e1rhelyi himself who, in his own <\/span>World No Tobacco Day statement<\/span><\/a> in May 2026, rebranded a <\/span>\u201ctobacco-free generation\u201d <\/span><\/i>into a <\/span>\u201ctobacco and nicotine-free generation.\u201d<\/span><\/i> One Commissioner added a word, and with it, folded vapes, nicotine pouches and heated tobacco into a goal they were never part of. The effect is to treat every nicotine product as if it carried the same risk as a cigarette, when the entire evidence base on tobacco harm reduction says the opposite.<\/span><\/p>\n

Science is wrong (according to V\u00e1rhelyi)<\/b><\/h4>\n

In September 2025, V\u00e1rhelyi <\/span>tweeted<\/span><\/a> that <\/span>\u201cnicotine\u2026causes cancer.\u201d<\/span><\/i> Cancer Research UK, the FDA and the WHO all agree that nicotine itself is not a carcinogen: the cancer risk in smoking comes from burning tobacco, not the nicotine in it. After criticism, V\u00e1rhelyi didn\u2019t retract the claim. He edited it to say nicotine <\/span>\u201ccontributes to cancer development,\u201d<\/span><\/i> a revision that still misinterprets the science.<\/span><\/p>\n

But V\u00e1rhelyi didn\u2019t stop there. In a <\/span>written response to MEP Kristoffer Storm<\/span><\/a>, V\u00e1rhelyi stated that smokeless nicotine products <\/span>\u201cdo not reduce health risk\u201d<\/span><\/i> compared with cigarettes, a claim at odds with health authorities in the UK, France and Germany, and with the FDA, all of which recognise a substantial risk reduction for smokers who switch. And when the Commission needed evidence to back its position that new nicotine products carry <\/span>risks <\/span>\u201ccomparable to smoking,\u201d<\/span><\/i><\/a> the study it leaned on didn\u2019t hold up either: tobacco researcher Peter Hajek pointed out that the <\/span>paper contradicted its own cited sources<\/span><\/a>, which found that nicotine products without combustion carry low risk compared with cigarette smoking.<\/span><\/p>\n

\u201cConsulting widely\u201d (as long as everyone agrees)<\/b><\/h4>\n

V\u00e1rhelyi also wrote that the European Commission <\/span>\u201cis consulting widely to ensure that citizens, young people, health professionals, researchers, public authorities, civil society and businesses can all have their say on the future EU tobacco control framework.\u201d<\/span><\/i> In practice, the consultation is built so that a response barely matters.<\/span><\/p>\n

The consultation\u2019s <\/span>own questionnaire<\/span><\/a> treats cigarettes, vapes, nicotine pouches and heated tobacco as a single category, as if they all carried the same risk. For anyone who understands the difference between smoke and vapour, that framing makes it structurally difficult to answer honestly. It reads less like a genuine consultation and more like a path toward a conclusion the Commission had already reached before it opened.<\/span><\/p>\n

That has already happened at least once. When the Commission <\/span>reviewed responses<\/span><\/a> to an earlier round of consultation on this same framework, it ignored the roughly 89% of respondents who opposed further restrictions. If that\u2019s what happened to public input last time, nothing in the current consultation\u2019s design suggests this round will be treated any differently.<\/span><\/p>\n

Brussels can\u2019t have it both ways<\/b><\/h4>\n

A <\/span>\u201cclear\u201d<\/span><\/i> goal and a <\/span>\u201cwide\u201d<\/span><\/i> consultation can\u2019t both be true. If the target is already fixed, the consultation is a formality. If the consultation is real, the target should be able to change based on what people say.<\/span><\/p>\n

V\u00e1rhelyi\u2019s post closes ironically with a hashtag: #EUHaveYourSay. But no number of submissions fixes a questionnaire built to produce one answer.\u00a0<\/span><\/p>","protected":false},"excerpt":{"rendered":"
