Panama-Stadt, 29.09.2023. \u2013<\/strong> Der Oberste Gerichtshof Panamas hat die Verfassungswidrigkeitsklage gegen das Gesetz 315 von 2022 angenommen.<\/a> Das Gesetz verbot in Panama die Verwendung, Einfuhr und den Vertrieb von elektronischen Nikotinabgabesystemen wie E-Zigaretten und Tabakerhitzern. Die Klage wurde von der Panamaer Vereinigung zur Tabakschadensminderung (ARDTP) eingereicht, der sich die Vereinigung der Raucher und ihrer Angeh\u00f6rigen f\u00fcr ein rauchfreies Panama (AFFP) und die Panamaer Vereinigung f\u00fcr medizinisches Cannabis (ACAPAN) anschlossen. Die Vereinigungen beantragten mit der Klage die Erkl\u00e4rung des Gesetzes 315 f\u00fcr verfassungswidrig, da es das Recht der Raucher auf Gesundheit im Land verletze. Bereits im M\u00e4rz hatte die ARDTP einen alternativen Regulierungsvorschlag zur \u00c4nderung des Gesetzes 315 von 2022 vorgelegt, der die Verwendung sichererer Nikotinprodukte f\u00fcr die \u00fcber 170.000 Raucher des Landes erm\u00f6glichen sollte.<\/p>\n

Die Klage liegt nun beim Obersten Gerichtshof, der pr\u00fcfen muss, ob sie \u201cgegen die Artikel 109 und 110 der Verfassung von Panama verst\u00f6\u00dft, indem sie die Erhaltung und den Schutz der Gesundheit der panamaischen Bev\u00f6lkerung nicht wirksam gew\u00e4hrleistet, indem sie Produkte verbietet, die nachweislich weniger sch\u00e4dlich f\u00fcr erwachsene Raucher und die Menschen in ihrer Umgebung sind\u201d.<\/p>\n

Alberto G\u00f3mez Hern\u00e1ndez, Community Manager f\u00fcr Spanien und Lateinamerika der World Vapers' Alliance, kommentierte:<\/p>\n

\u201cWir hoffen, dass der Oberste Gerichtshof von Panama die wissenschaftlichen Erkenntnisse zum Thema E-Zigaretten pr\u00fcft, die Stimmen der Nutzer ber\u00fccksichtigt und das Gesetz 315 von 2022 f\u00fcr verfassungswidrig erkl\u00e4rt. Die Gerechtigkeit muss das Recht auf Gesundheit von Rauchern und Dampfern sch\u00fctzen. E-Zigaretten sind die effektivste Methode, mit dem Rauchen aufzuh\u00f6ren, und das Verbot hat Dampfer in den Schwarzmarkt getrieben und alle Raucher zum Weiterrauchen gezwungen. Das Verbot ist offensichtlich wirkungslos. Es muss vom Obersten Gerichtshof aufgehoben werden, und die Regierung muss, wie Gro\u00dfbritannien und Schweden mit gro\u00dfem Erfolg, eine offene Haltung gegen\u00fcber alternativen Nikotinprodukten einnehmen.<\/em>\u201d<\/p>\n

Die Klage wirft zudem vor, dass bei der Verabschiedung des Gesetzes 315 Verfassungsbestimmungen verletzt wurden. So habe die Anzahl der Ja-Stimmen der Abgeordneten der Nationalversammlung in der dritten Lesung nicht die in der panamaischen Verfassung festgelegte Mindestanzahl erreicht. Seit der Verabschiedung des Gesetzes habe sich der gesamte Handel mit rauchfreien Ger\u00e4ten auf den Schwarzmarkt verlagert.<\/p>\n

Tom\u00e1s S\u00e1nchez, Pr\u00e4sident des panamaischen Verbandes zur Tabakschadensminderung, f\u00fcgte hinzu:<\/p>\n

\u201cDas Verbot verletzt unser Recht auf Gesundheit und zwingt uns, die Produkte auf dem Schwarzmarkt zu kaufen, wo sie keinen Sicherheits- und Qualit\u00e4tskontrollen unterliegen und Verk\u00e4ufer nicht f\u00fcr gef\u00e4hrliche oder fehlerhafte Produkte haften. Zudem unterliegt der Verkauf an Minderj\u00e4hrige auf dem Schwarzmarkt keinen Beschr\u00e4nkungen. Das Verbot ist nicht nur verfassungswidrig, sondern schadet auch der \u00f6ffentlichen Gesundheit des Landes. Es muss vom Obersten Gerichtshof aufgehoben werden, und die panamaische Regierung muss eine risikobasierte Regulierung alternativer Nikotinprodukte erlassen.<\/em>\u201c<\/p>\n

In Panama sterben j\u00e4hrlich fast 1.000 Menschen an tabakbedingten Krankheiten. Das Verbot von E-Zigaretten und anderen Produkten mit reduziertem Risiko versch\u00e4rft diese Zahl, da Tausende von Dampfern gezwungen werden, wieder auf Tabakprodukte umzusteigen oder auf Schwarzmarktprodukte zur\u00fcckzugreifen.
