Am 10. M\u00e4rz 2023 ver\u00f6ffentlichte die US-amerikanische Lebensmittel- und Arzneimittelbeh\u00f6rde (FDA) einen lang erwarteten Verordnungsentwurf zu den Anforderungen an die Herstellungspraxis von Tabakprodukten. Dieser Entwurf legt Anforderungen f\u00fcr die Herstellung, das Design, die Verpackung und die Lagerung von Tabakwaren fest. Die vorgeschlagenen Anforderungen entsprechen im Wesentlichen den \u201cguten Herstellungspraktiken\u201d f\u00fcr Tabakwaren und sollen zus\u00e4tzliche Risiken im Zusammenhang mit diesen Produkten minimieren und verhindern. Sie gelten sowohl f\u00fcr inl\u00e4ndische als auch f\u00fcr ausl\u00e4ndische Hersteller von Fertig- und Rohtabakprodukten.<\/span><\/p>\n

F\u00fcr Vape-Shops stellt die vorgeschlagene Regelung klar, dass solche Einrichtungen, die ausschlie\u00dflich ENDS-Produkte und -Komponenten verkaufen, nicht als Hersteller gelten und daher nicht den Anforderungen der vorgeschlagenen TPMP-Regelung unterliegen, es sei denn, sie sind auch an der Herstellung, der Validierung des Designs vor der Produktion, der Verpackung und der Lagerung von fertigen oder unverpackten Tabakprodukten im Sinne der Regelung beteiligt.<\/span><\/p>\n

Diese Regelung w\u00fcrde \u201cKleinunternehmen f\u00fcr 4 Jahre nach Inkrafttreten der endg\u00fcltigen Regelung\u201d nicht betreffen, aber sie wirft die Frage auf\u2026 Wie viele kleine Vape-Shops erwartet die FDA in 4 Jahren noch zu haben, und warum diese Verz\u00f6gerung speziell f\u00fcr diese Kleinunternehmen?\u00a0 <\/span>Die FDA definiert ein Kleinunternehmen als einen Produkthersteller mit 350 oder weniger Mitarbeitern.<\/span><\/i><\/p>\n

Die FDA wird eine \u00f6ffentliche Anh\u00f6rung veranstalten zu\u00a0<\/span>12. April 2023<\/b>, Um Stellungnahmen von Interessengruppen, darunter Industrie, Wissenschaft, Interessenverb\u00e4nde und \u00d6ffentlichkeit, einzuholen, wird die FDA au\u00dferdem eine Sitzung des Wissenschaftlichen Beirats f\u00fcr Tabakprodukte abhalten.\u00a0<\/span>18. Mai 2023<\/b>, Um Empfehlungen des externen Expertengremiums der FDA zu den in der vorgeschlagenen Regelung festgelegten Anforderungen einzuholen, wird die \u00d6ffentlichkeit im Rahmen der TPSAC-Sitzung Gelegenheit haben, m\u00fcndliche Pr\u00e4sentationen zu halten.<\/span><\/p>\n
