World Vapers&#039; Alliance (WVA) har netop svaret p\u00e5 Kommissionens <\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/16232-Communication-on-better-regulation\/F33370929_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">opfordring til bevismateriale<\/span><\/a><span style=\"font-weight: 400;\"> om sine retningslinjer for bedre regulering for at fremh\u00e6ve et enkelt budskab: Man kan ikke kalde det &quot;bedre&quot;, hvis man udelukker de mennesker, der lever med konsekvenserne.<\/span><\/p>\n<p><b>Borgere er ikke en boks, man skal s\u00e6tte kryds i<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Som forbrugerbev\u00e6gelse repr\u00e6senterer WVA titusindvis af brugere af mindre skadelige nikotinprodukter i hele Europa. Mange af dem er skiftet fra rygning til vaping eller nikotinposer og \u00f8nsker, at deres erfaringer skal informere EU&#039;s politikudformning. De deltager i h\u00f8ringer, skriver til deres medlemmer af Europa-Parlamentet og deltager i kampagner, fordi EU eksplicit inviterer borgerne til at deltage.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alligevel er der en voksende f\u00f8lelse af, at disse bestr\u00e6belser behandles som en formalitet. Offentlige h\u00f8ringer og indkaldelser af bevismateriale h\u00e5ndteres alt for ofte som administrative skridt til at &quot;afstemme&quot; snarere end som et oprigtigt fors\u00f8g p\u00e5 at h\u00f8re, hvad borgerne mener. N\u00e5r svar stemmer overens med, hvad Kommissionen allerede \u00f8nskede at g\u00f8re, bliver de budt velkommen som &quot;st\u00f8tte&quot;. N\u00e5r de ikke g\u00f8r det, bliver de stille og roligt skubbet til side eller omformuleret som p\u00e5 en eller anden m\u00e5de mindre legitime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For WVA er dette ikke en procedurem\u00e6ssig detalje \u2013 det er et demokratisk problem. Hvis folk investerer tid og energi i at deltage, kun for at se deres synspunkter blive afvist, fordi de er ubelejlige, hvorfor skulle de s\u00e5 blive ved med at engagere sig? Et bedre reguleringssystem, der demotiverer borgerne, fejler i sin mest grundl\u00e6ggende funktion.<\/span><\/p>\n<p><b>Fra konsultation til gummistempel<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Vores erfaring med tobaks- og nikotinpolitik viser, hvordan dette udspiller sig i praksis. H\u00f8ringer, konsekvensanalyser og evalueringsrapporter er obligatoriske skridt, som Europa-Kommissionen skal igennem, og de skal forme de politiske valgmuligheder. I stedet synes de ofte at blive udarbejdet, efter at de vigtigste politiske beslutninger allerede er truffet, og bruges til at retf\u00e6rdigg\u00f8re en valgt linje snarere end at udfordre den.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I adskillige sager relateret til tobak og nikotin har borgere og forbrugergrupper indsendt et stort antal svar imod strengere restriktioner p\u00e5 mindre skadelige alternativer som vaping og nikotinposer. I stedet for at foranledige en gent\u00e6nkning bortforklares denne modstand ofte: Respondenterne bliver stemplet som &quot;branchetilsluttet&quot;, falske eller bots, deres oplevelser med at holde op med at ryge behandles som anekdotiske, og forslagene forts\u00e6tter stort set u\u00e6ndrede.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Den formelle proces best\u00e5r, men dens \u00e5nd udhules. Det, der burde v\u00e6re et kompas, bliver til et gummistempel.<\/span><\/p>\n<p><b>Sm\u00e6de borgere for at bringe dem til tavshed<\/b><\/p>\n<p><span style=\"font-weight: 400;\">En s\u00e6rlig bekymrende udvikling er den m\u00e5de, hvorp\u00e5 nogle akt\u00f8rer har fors\u00f8gt at miskreditere hele grupper af respondenter. I h\u00f8ringen om tobaksafgiftsdirektivet brugte tusindvis af europ\u00e6ere officielle EU-kanaler til at sige, at h\u00f8jere afgifter p\u00e5 sikrere nikotinprodukter ville skade folkesundheden ved at presse folk tilbage til cigaretter eller ind p\u00e5 ulovlige markeder. En god opsummering af svarene kan findes <\/span><a href=\"https:\/\/pfsaunier.com\/euconsultation\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">her<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alligevel, i stedet for seri\u00f8st at engagere sig i disse argumenter, opstod en fort\u00e6lling om, at mange af disse svar var &quot;falske&quot;, orkestrerede eller illegitime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EN <\/span><a href=\"https:\/\/clearingtheair.eu\/en\/post\/investigation-how-a-mysterious-ngo-is-smearing-ordinary-people-2\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Clearing the Air-unders\u00f8gelsen<\/span><\/a><span style=\"font-weight: 400;\"> afsl\u00f8rede, hvordan en mindre kendt NGO hjalp med at dyrke denne historie ved at fremstille almindelige borgere som kunstgr\u00e6s eller &quot;branchefronter&quot;, simpelthen fordi de modsatte sig Kommissionens retning. Denne sm\u00e6dekampagne forn\u00e6rmede ikke blot enkeltpersoner; den gav en bekvem undskyldning for at undervurdere deres synspunkter, og det ser ud til, at Europa-Kommissionen k\u00f8ber den. N\u00e5r folk kan blive stemplet som marionetter, beh\u00f8ver man ikke l\u00e6ngere at lytte til, hvad de rent faktisk sagde.<\/span><\/p>\n<p><b>Hvad bedre regulering b\u00f8r betyde<\/b><\/p>\n<p><span style=\"font-weight: 400;\">I vores indl\u00e6g til Kommissionen argumenterer vi for, at retningslinjerne for bedre regulering skal bringes tilbage til deres kerneform\u00e5l: at g\u00f8re EU-retten b\u00e5de mere effektiv og mere demokratisk. Det kr\u00e6ver mere borgerinddragelse, ikke mindre.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For dampere og brugere af andre nikotinprodukter med reduceret risiko har disse procedurem\u00e6ssige problemer meget reelle konsekvenser. N\u00e5r borgere udelukkes, formes politikker vedr\u00f8rende dampning, poser eller produkter, der ikke br\u00e6ndes, af dem, der aldrig har brugt dem \u2013 eller som er ideologisk imod dem. Det er s\u00e5dan, vi ender med smagsforbud, overdrevne skatter og restriktioner, der ignorerer de levede erfaringer hos millioner af mennesker, der holder op med at ryge takket v\u00e6re disse alternativer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Men det handler ikke kun om nikotin. Hvis offentlig deltagelse kan ignoreres p\u00e5 \u00e9t omr\u00e5de, kan det ignoreres p\u00e5 andre. I dag kan det handle om skadesreduktion; i morgen kan det handle om mad, alkohol, transport eller digitale rettigheder. Et bedre reguleringssystem, der giver institutioner mulighed for at udv\u00e6lge, hvilke borgere der t\u00e6ller, er farligt for alle.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">World Vapers&#039; Alliance vil forts\u00e6tte med at forst\u00e6rke forbrugernes stemmer og forsvare deres ret til at blive h\u00f8rt om politikker, der former deres liv.
