Panama City, 29.09.2023. \u2013<\/strong> Panamas h\u00f8jesteret accepterer s\u00f8gsm\u00e5let om forfatningsstridighed mod lov 315 af 2022<\/a> der forb\u00f8d brugen, importen og kommercialiseringen af elektroniske nikotinleveringssystemer, s\u00e5som e-cigaretter og opvarmede tobaksvarer, i Panama. S\u00f8gsm\u00e5let blev anlagt af Panamanian Tobacco Harm Reduction Association (ARDTP) og blev st\u00f8ttet af Association of Smokers and Family Members for a Smoke-Free Panama (AFFP) og Medical Cannabis Association of Panama (ACAPAN). Gennem s\u00f8gsm\u00e5let anmodede foreningerne om, at lov 315 blev erkl\u00e6ret forfatningsstridig, da den kr\u00e6nker rygernes ret til sundhed i landet. Allerede i marts pr\u00e6senterede ARDTP et alternativt lovgivningsforslag om at \u00e6ndre lov 315 fra 2022 og tillade brugen af sikrere nikotinprodukter for de mere end 170.000 rygere i landet.<\/p>\n

Retssagen er nu i h\u00e6nderne p\u00e5 H\u00f8jesteret, som skal efterpr\u00f8ve, om den "overtr\u00e6der artikel 109 og 110 i Panamas forfatning ved ikke effektivt at sikre bevarelsen og beskyttelsen af den panamanske befolknings sundhed ved at forbyde produkter, der p\u00e5viseligt er mindre skadelige for voksne rygere og mennesker omkring dem".<\/p>\n

Alberto G\u00f3mez Hern\u00e1ndez, Community Manager for Spanien og Latinamerika hos World Vapers' Alliance, kommenterede:<\/p>\n

\u201c"\u201cVi h\u00e5ber, at Panamas h\u00f8jesteret vil gennemg\u00e5 de videnskabelige beviser for vaping, lytte til brugerne og erkl\u00e6re lov 315 af 2022 forfatningsstridig. Retf\u00e6rdigheden skal beskytte rygeres og vapers ret til sundhed. Vaping er den mest effektive metode til at holde op med at ryge, og forbuddet har d\u00f8mt vapers til det sorte marked og alle rygere til at forts\u00e6tte med at ryge. Forbuddet virker tydeligvis ikke. Det skal omst\u00f8des af h\u00f8jesteret, og regeringen skal indtage en \u00e5ben tilgang til alternative nikotinprodukter, ligesom Storbritannien og Sverige har gjort med stor succes.<\/em>\u201d<\/p>\n

S\u00f8gsm\u00e5let h\u00e6vder ogs\u00e5, at forfatningsm\u00e6ssige bestemmelser blev overtr\u00e5dt under godkendelsesprocessen for lov 315, og det fastsl\u00e5s, at antallet af stemmer for afgivet af Nationalforsamlingens medlemmer i den tredje debat om godkendelse af lovforslaget ikke n\u00e5ede det minimumstal, der er fastsat i Panamas forfatning. \u201c"\u201cForbuddet kr\u00e6nker vores ret til sundhed og tvinger os til at k\u00f8be produkterne p\u00e5 det sorte marked, hvor de ikke best\u00e5r sikkerheds- og kvalitetskontroller, og s\u00e6lgere ikke er ansvarlige for farlige eller defekte produkter. Desuden begr\u00e6nser det sorte marked ikke salget af produkterne til mindre\u00e5rige. Forbuddet er ikke kun forfatningsstridigt, men det skader ogs\u00e5 landets folkesundhed. Det skal omst\u00f8des af H\u00f8jesteret, og den panamanske regering skal vedtage en risikobaseret regulering af alternative nikotinprodukter.<\/em>\u201c"\u201c<\/p>\n

N\u00e6sten 1.000 mennesker d\u00f8r hvert \u00e5r i Panama af tobaksrelaterede sygdomme. Forbuddet mod vaping og andre produkter med reduceret risiko \u00f8ger dette tal ved at tvinge tusindvis af vapers til at vende tilbage til tobak eller ty til sortb\u00f8rsprodukter.
