Kdy\u017e Evropsk\u00e1 komise hovo\u0159\u00ed o \u201c\u2026\u201c<\/span>Lep\u0161\u00ed regulace<\/span><\/a>,\u201dslibuje chyt\u0159ej\u0161\u00ed z\u00e1kony, v\u011bt\u0161\u00ed transparentnost a \u00fast\u0159edn\u00ed roli pro ob\u010dany. V praxi v\u0161ak oby\u010dejn\u00ed lid\u00e9, kte\u0159\u00ed si ud\u011blaj\u00ed \u010das na zapojen\u00ed se do konzultac\u00ed EU, \u010dasto zji\u0161\u0165uj\u00ed n\u011bco \u00fapln\u011b jin\u00e9ho: jejich hlasy jsou odsunuty na vedlej\u0161\u00ed kolej, zdiskreditov\u00e1ny nebo jednodu\u0161e ignorov\u00e1ny. Sv\u011btov\u00e1 aliance vaper\u016f (WVA) pr\u00e1v\u011b reagovala na doporu\u010den\u00ed Komise\u2026 <\/span>v\u00fdzva k p\u0159edlo\u017een\u00ed d\u016fkaz\u016f<\/span><\/a> ve sv\u00fdch pokynech pro zlep\u0161ov\u00e1n\u00ed pr\u00e1vn\u00ed \u00fapravy zd\u016fraznila jednoduch\u00e9 sd\u011blen\u00ed: nem\u016f\u017eete to nazvat \u201clep\u0161\u00edm\u201d, pokud vylou\u010d\u00edte lidi, kte\u0159\u00ed \u017eij\u00ed s n\u00e1sledky.<\/span><\/p>\n

Ob\u010dan\u00e9 nejsou pol\u00ed\u010dko, kter\u00e9 je t\u0159eba od\u0161krtnout<\/b><\/p>\n

Jako spot\u0159ebitelsk\u00e9 hnut\u00ed zastupuje WVA des\u00edtky tis\u00edc u\u017eivatel\u016f m\u00e9n\u011b \u0161kodliv\u00fdch nikotinov\u00fdch v\u00fdrobk\u016f po cel\u00e9 Evrop\u011b. Mnoz\u00ed z nich p\u0159e\u0161li z kou\u0159en\u00ed na vaping nebo nikotinov\u00e9 s\u00e1\u010dky a cht\u011bj\u00ed, aby jejich zku\u0161enosti ovlivnily tvorbu politik EU. Reaguj\u00ed na konzultace, p\u00ed\u0161\u00ed sv\u00fdm poslanc\u016fm Evropsk\u00e9ho parlamentu a zapojuj\u00ed se do kampan\u00ed, proto\u017ee EU v\u00fdslovn\u011b vyz\u00fdv\u00e1 ob\u010dany k \u00fa\u010dasti.<\/span><\/p>\n

P\u0159esto st\u00e1le v\u00edce p\u0159evl\u00e1d\u00e1 pocit, \u017ee se s t\u00edmto \u00fasil\u00edm zach\u00e1z\u00ed jako s formalitou. Ve\u0159ejn\u00e9 konzultace a v\u00fdzvy k p\u0159edkl\u00e1d\u00e1n\u00ed d\u016fkaz\u016f jsou p\u0159\u00edli\u0161 \u010dasto ch\u00e1p\u00e1ny jako administrativn\u00ed kroky k \u201cod\u0161krtnut\u00ed\u201d, sp\u00ed\u0161e ne\u017e jako skute\u010dn\u00fd pokus sly\u0161et, co si mysl\u00ed ob\u010dan\u00e9. Pokud se reakce shoduj\u00ed s t\u00edm, co Komise ji\u017e cht\u011bla ud\u011blat, jsou v\u00edt\u00e1ny jako \u201cpodpora\u201d. Pokud se neshoduj\u00ed, jsou ti\u0161e odsunuty stranou nebo p\u0159eformulov\u00e1ny jako m\u00e9n\u011b legitimn\u00ed.<\/span><\/p>\n

Pro WVA to nen\u00ed procedur\u00e1ln\u00ed detail \u2013 je to demokratick\u00fd probl\u00e9m. Pokud lid\u00e9 investuj\u00ed \u010das a energii do \u00fa\u010dasti, jen aby pak vid\u011bli, \u017ee jejich n\u00e1zory jsou odm\u00edt\u00e1ny, proto\u017ee jsou nepohodln\u00e9, pro\u010d by se d\u00e1l anga\u017eovali? Syst\u00e9m zlep\u0161ov\u00e1n\u00ed pr\u00e1vn\u00ed \u00fapravy, kter\u00fd demotivuje ob\u010dany, selh\u00e1v\u00e1 ve sv\u00e9m nejz\u00e1kladn\u011bj\u0161\u00edm \u00fakolu.<\/span><\/p>\n

Od konzultace k raz\u00edtku<\/b><\/p>\n

Na\u0161e zku\u0161enosti s politikou t\u00fdkaj\u00edc\u00ed se tab\u00e1ku a nikotinu ukazuj\u00ed, jak se to projevuje v praxi. Konzultace, posouzen\u00ed dopad\u016f a hodnot\u00edc\u00ed zpr\u00e1vy jsou povinn\u00e9 kroky, kter\u00e9 mus\u00ed Evropsk\u00e1 komise proj\u00edt, a maj\u00ed formovat politick\u00e9 mo\u017enosti. M\u00edsto toho se \u010dasto zd\u00e1, \u017ee jsou navrhov\u00e1ny a\u017e pot\u00e9, co byla p\u0159ijata kl\u00ed\u010dov\u00e1 politick\u00e1 rozhodnut\u00ed, a slou\u017e\u00ed sp\u00ed\u0161e k od\u016fvodn\u011bn\u00ed zvolen\u00e9 linie ne\u017e k jej\u00edmu zpochybn\u011bn\u00ed.<\/span><\/p>\n

V n\u011bkolika spisech t\u00fdkaj\u00edc\u00edch se tab\u00e1ku a nikotinu ob\u010dan\u00e9 a spot\u0159ebitelsk\u00e9 skupiny p\u0159edlo\u017eili velk\u00e9 mno\u017estv\u00ed reakc\u00ed proti p\u0159\u00edsn\u011bj\u0161\u00edm omezen\u00edm m\u00e9n\u011b \u0161kodliv\u00fdch alternativ, jako jsou vaping a nikotinov\u00e9 s\u00e1\u010dky. M\u00edsto toho, aby se tento odpor podn\u00edtil k p\u0159ehodnocen\u00ed, je \u010dasto vysv\u011btlov\u00e1n: respondenti jsou ozna\u010dov\u00e1ni za \u201czast\u00e1nce odv\u011btv\u00ed\u201d, fale\u0161n\u00e9 nebo boty, jejich zku\u0161enosti s odvyk\u00e1n\u00edm kou\u0159en\u00ed jsou pova\u017eov\u00e1ny za neofici\u00e1ln\u00ed a n\u00e1vrhy postupuj\u00ed do zna\u010dn\u00e9 m\u00edry beze zm\u011bny.\u00a0<\/span><\/p>\n

Obzvl\u00e1\u0161t\u011b znepokojiv\u00fd je zp\u016fsob, jak\u00fdm se n\u011bkte\u0159\u00ed akt\u00e9\u0159i sna\u017eili zdiskreditovat cel\u00e9 skupiny respondent\u016f. V r\u00e1mci konzultace o sm\u011brnici o dani z tab\u00e1ku tis\u00edce Evropan\u016f vyu\u017eily ofici\u00e1ln\u00edch kan\u00e1l\u016f EU k prohl\u00e1\u0161en\u00ed, \u017ee vy\u0161\u0161\u00ed dan\u011b z bezpe\u010dn\u011bj\u0161\u00edch nikotinov\u00fdch v\u00fdrobk\u016f by po\u0161kodily ve\u0159ejn\u00e9 zdrav\u00ed t\u00edm, \u017ee by lidi donutily vr\u00e1tit se k cigaret\u00e1m nebo na neleg\u00e1ln\u00ed trhy. A <\/span>Vy\u0161et\u0159ov\u00e1n\u00ed Clearing the Air<\/span><\/a> odhalila, jak m\u00e1lo zn\u00e1m\u00e1 nevl\u00e1dn\u00ed organizace pomohla k \u0161\u00ed\u0159en\u00ed tohoto p\u0159\u00edb\u011bhu, kdy\u017e oby\u010dejn\u00e9 ob\u010dany ozna\u010dila za kosmonauty nebo \u201cpr\u016fmyslov\u00e9 fronty\u201d jen proto, \u017ee se stav\u011bli proti sm\u011b\u0159ov\u00e1n\u00ed Komise. Tato pomlouva\u010dn\u00e1 kampa\u0148 nejen ur\u00e1\u017eela jednotlivce, ale poskytla jim i pohodlnou z\u00e1minku k ignorov\u00e1n\u00ed jejich n\u00e1zor\u016f a zd\u00e1 se, \u017ee Evropsk\u00e1 komise tomu v\u011b\u0159\u00ed. Jakmile lze lidi ozna\u010dit za loutky, u\u017e nemus\u00edte poslouchat, co skute\u010dn\u011b \u0159\u00edkaj\u00ed.<\/span><\/p>\n

V na\u0161em pod\u00e1n\u00ed Komisi tvrd\u00edme, \u017ee je t\u0159eba vr\u00e1tit se k hlavn\u00edmu \u00fa\u010delu pokyn\u016f pro zlep\u0161ov\u00e1n\u00ed pr\u00e1vn\u00ed \u00fapravy: u\u010dinit pr\u00e1vo EU efektivn\u011bj\u0161\u00edm a demokrati\u010dt\u011bj\u0161\u00edm. To vy\u017eaduje v\u011bt\u0161\u00ed, nikoli men\u0161\u00ed zapojen\u00ed ob\u010dan\u016f.<\/span><\/p>\n

Pro vapery a u\u017eivatele jin\u00fdch nikotinov\u00fdch produkt\u016f se sn\u00ed\u017een\u00fdm rizikem maj\u00ed tyto procedur\u00e1ln\u00ed ot\u00e1zky velmi re\u00e1ln\u00e9 d\u016fsledky. Pokud jsou ob\u010dan\u00e9 vylou\u010deni, politiky t\u00fdkaj\u00edc\u00ed se vapov\u00e1n\u00ed, s\u00e1\u010dk\u016f nebo produkt\u016f, kter\u00e9 se nezah\u0159\u00edvaj\u00ed, utv\u00e1\u0159ej\u00ed ti, kte\u0159\u00ed je nikdy nepou\u017e\u00edvali \u2013 nebo kte\u0159\u00ed se k nim stav\u00ed ideologicky. Takto kon\u010d\u00edme se z\u00e1kazy p\u0159\u00edchut\u00ed, nadm\u011brn\u00fdmi dan\u011bmi a omezen\u00edmi, kter\u00e1 ignoruj\u00ed \u017eivotn\u00ed zku\u0161enosti milion\u016f lid\u00ed, kte\u0159\u00ed d\u00edky t\u011bmto alternativ\u00e1m p\u0159estali kou\u0159it.<\/span><\/p>\n

Ale nejde jen o nikotin. Pokud lze ve\u0159ejnou \u00fa\u010dast ignorovat v jedn\u00e9 oblasti, lze ji ignorovat i v jin\u00fdch. Dnes to m\u016f\u017ee b\u00fdt sni\u017eov\u00e1n\u00ed \u0161kod; z\u00edtra to mohou b\u00fdt potraviny, alkohol, doprava nebo digit\u00e1ln\u00ed pr\u00e1va. Syst\u00e9m lep\u0161\u00ed regulace, kter\u00fd umo\u017e\u0148uje instituc\u00edm vyb\u00edrat si, kte\u0159\u00ed ob\u010dan\u00e9 se po\u010d\u00edtaj\u00ed, je nebezpe\u010dn\u00fd pro v\u0161echny.<\/span><\/p>\n

Sv\u011btov\u00e1 aliance vaper\u016f bude i nad\u00e1le zesilovat hlasy spot\u0159ebitel\u016f a h\u00e1jit jejich pr\u00e1vo b\u00fdt sly\u0161eni ohledn\u011b politik, kter\u00e9 formuj\u00ed jejich \u017eivoty.
