Desv\u00e6rre er de fleste sp\u00f8rgsm\u00e5l fra vores synspunkt partiske, vildledende, umulige at besvare eller \u00e5bne for fortolkning. Det lader til, at EU-Kommissionen \u00f8nsker at retf\u00e6rdigg\u00f8re sin fjendtlige holdning til skadesreduktion med denne sp\u00f8rgeskema.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dette er endnu en forpasset mulighed for, at Kommissionen endelig kan indlede en \u00e6rlig og videnskabeligt baseret dialog med ALLE interessenter. Skadebegr\u00e6nsning skal v\u00e6re et centralt element i revisionen af tobaksvaredirektivet, hvis EU sigter mod at n\u00e5 sit m\u00e5l om r\u00f8gfrihed inden 2040.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kun \u00e9t land i EU er p\u00e5 rette vej til at n\u00e5 m\u00e5let: Sverige. Faktisk vil Sverige allerede n\u00e5 m\u00e5let om r\u00f8gfrihed i \u00e5r, og ironisk nok er det det eneste land med en vis juridisk fleksibilitet i forhold til Tobaksvaredirektivet. Det er tid til fuldt ud at omfavne skadesreduktion i EU.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">World Vapers Alliance gav med &quot;Vaping Products Directive&quot; (se andet bilag) en mulig vej frem til at n\u00e5 EU&#039;s r\u00f8gfrihedsm\u00e5l.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nedenfor vil vi vise nogle eksempler p\u00e5 sp\u00f8rgsm\u00e5l, som vi anser for at v\u00e6re forudindtagede eller \u00e5bne for fortolkning.\u00a0<\/span><b><\/b><\/p>\n<ul>\n<li aria-level=\"1\"><b>Hvad er din opfattelse af tobakskontrolpolitikkerne i EU?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Vi s\u00e5 selvf\u00f8lgelig forbedringer i folkesundheden i EU. Hvad ang\u00e5r reduktion af rygning og rygerelaterede sygdomme, skyldes denne forbedring dog innovation og\u00a0<\/span><span style=\"font-weight: 400;\">indf\u00f8relsen af mindre skadelige alternativer til cigaretter \u2013 ikke p\u00e5 grund af EU-regler. I \u00f8jeblikket er EU-reglerne en hindring og ikke l\u00f8sningen til at reducere rygerater.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sverige har den <\/span><a href=\"https:\/\/europa.eu\/eurobarometer\/surveys\/detail\/2240\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">laveste rygerate<\/span><\/a><span style=\"font-weight: 400;\"> i EU og er det eneste land, der er p\u00e5 rette vej til at n\u00e5 EU&#039;s m\u00e5l om r\u00f8gfrihed.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">I det seneste \u00e5rti er rygeraten i Sverige <\/span><a href=\"http:\/\/fohm-app.folkhalsomyndigheten.se\/Folkhalsodata\/pxweb\/sv\/A_Folkhalsodata\/A_Folkhalsodata__B_HLV__aLevvanor__aagLevvanortobak\/hlv1tobaald.px\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">afvist af 55%<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Den gennemsnitlige rygerate i resten af EU er mere end 3,5 gange h\u00f8jere<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rygningsrelaterede d\u00f8dsfald er <\/span><a href=\"https:\/\/knowledge4policy.ec.europa.eu\/health-promotion-knowledge-gateway\/smoking-deaths_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">22% lavere<\/span><\/a><span style=\"font-weight: 400;\"> i Sverige end EU-gennemsnittet<\/span><\/li>\n<\/ul>\n<p><b>Derfor skal EU f\u00f8lge Sveriges vej med alle kommende reguleringer. Fuldt ud omfavne skadesreduktion og indf\u00f8re risikobaseret regulering.<\/b><span style=\"font-weight: 400;\"> Vaping, nikotinposer, snus og lignende produkter er ikke det samme som rygning og m\u00e5 ikke behandles ens!\u00a0<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Var f\u00f8lgende bestemmelser i tobaksvaredirektivet tilstr\u00e6kkelige til at sikre et h\u00f8jt niveau af beskyttelse af menneskers sundhed i EU, i betragtning af de? <\/b><b><br \/>\n<\/b><b>Fasts\u00e6ttelse af maksimal nikotinkoncentration for nikotinholdige v\u00e6sker. Regulering af maksimale m\u00e6ngder af genopfyldningsbeholdere og engangspatroner\/-tanke.<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">(Svarmulighederne sp\u00e6nder fra meget tilstr\u00e6kkelig til meget utilstr\u00e6kkelig.)\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Den maksimale nikotinkoncentration til vaping hindrer is\u00e6r storrygere \u2013 som har brug for h\u00f8je nikotinkoncentrationer \u2013 i at skifte til vaping. Som s\u00e5dan er den ikke tilstr\u00e6kkelig til at beskytte menneskers sundhed. Men vi frygter, at Kommissionen vil fortolke alle svar, der siger utilstr\u00e6kkeligt, som &quot;vi har brug for lavere nikotinniveauer&quot;. Dette er ikke en upartisk form for sp\u00f8rgsm\u00e5lstegn.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Det samme g\u00e6lder for maksimale m\u00e6ngder containere. Gr\u00e6nserne er skadelige for folkesundheden og milj\u00f8et. Men hvis vi siger utilstr\u00e6kkelige, kan Kommissionen fortolke svaret som, at vi har brug for lavere m\u00e6ngder.\u00a0<\/span><\/p>\n<p><b>Denne sp\u00f8rgeskemagengivelse g\u00e5r igen i hele sp\u00f8rgeskemaet. Kommissionen kan derfor betragte alle sp\u00f8rgsm\u00e5l, vi har besvaret med &quot;Ved ikke&quot;, som vildledende, forudindtaget eller for \u00e5bne til fortolkning.<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Var f\u00f8lgende bestemmelser i Tobaksvaredirektivet i stand til at im\u00f8dekomme den seneste markedsudvikling?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Her er det ikke engang klart, hvad der menes med &quot;at adressere&quot;. I betragtning af Kommissionens fjendtlighed over for skadesreduktion skal det fortolkes som at afskaffe disse produkter, hvilket ikke forbedrer folkesundheden.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>I hvilken grad tror du, at brugen af f\u00f8lgende produkter vil forts\u00e6tte med at stige i de n\u00e6ste 10 \u00e5r?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dette afh\u00e6nger af fremtidige EU-regler. Vi h\u00e5ber at se lignende udviklinger i Sverige og Storbritannien, hvor rygerater falder kraftigt, og rygere i massevis skifter til mindre skadelige alternativer. Vi undlader at besvare sp\u00f8rgsm\u00e5let, fordi vi frygter, at EU-Kommissionen vil fortolke en forudsigelse om en stigning i brugen af skadesreducerende produkter som et behov for strammere regulering.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hvilke af f\u00f8lgende produkter tror du, at unge mennesker er mest tiltrukket af? <\/b><span style=\"font-weight: 400;\">(Flere muligheder)\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Vi h\u00e5ber, det ikke bliver cigaretter, men dette sp\u00f8rgsm\u00e5l synes at have til form\u00e5l at skabe det indtryk, at problemet ville v\u00e6re mindre skadelige alternativer.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hvad ang\u00e5r TPD artikel 7(12), mener du, at det at tillade en undtagelse for nye tobaksvarer fra forbuddet mod karakteristiske smagsstoffer gjorde disse produkter mere attraktive for unge mennesker?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Smagsstoffer er n\u00f8glen til dens succes som rygestophj\u00e6lp for voksne. S\u00e5 hvorfor overse millioner af voksne rygere fuldst\u00e6ndigt, n\u00e5r det kommer til smagsstoffer? Igen synes Kommissionen kun at v\u00e6re interesseret i at f\u00e5 skadesreducerende produkter til at fremst\u00e5 farlige for folkesundheden, mens det modsatte er tilf\u00e6ldet.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Er de relevante bestemmelser i Tobaksvaredirektivet fleksible nok til at im\u00f8dekomme f\u00f8lgende bekymringer?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Igen, ingen definition af &quot;adresse&quot;.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Var f\u00f8lgende bestemmelser i TAD og i TPD artikel 20(5) effektive til at sikre et h\u00f8jt niveau af sundhedsbeskyttelse i EU?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">(Svarmulighederne sp\u00e6nder fra &quot;slet ikke&quot; til &quot;ja, de var effektive&quot;)\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Samme problem igen. De fleste bestemmelser var ineffektive, men vi frygter, at hvis vi v\u00e6lger denne l\u00f8sning, vil den blive fortolket som ikke streng nok. Vi har brug for differentiering i henhold til risikoprofilerne for forskellige produkter, ikke bare mere regulering.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hvilken salgskanal anser du for at v\u00e6re problematisk i forhold til reglerne for aldersbekr\u00e6ftelse?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Meget forenklet sp\u00f8rgsm\u00e5l, hvor man kun kan v\u00e6lge produkter. Hvis et af salgsartiklerne er problematisk for \u00e9t produkt, ville det s\u00e5 ikke ogs\u00e5 v\u00e6re problematisk for andre? Dette sp\u00f8rgsm\u00e5l giver ikke meget mening.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Mener du, at salget af f\u00f8lgende produktkategorier burde have v\u00e6ret forbudt p\u00e5 f\u00f8lgende steder?<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Samme problem. Ingen mulighed for nuancerede svar eller en mulighed, hvis du er imod salgsforbud.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Synes du, at synligheden p\u00e5 salgssteder for f\u00f8lgende produkter burde have v\u00e6ret begr\u00e6nset, hvis ikke allerede?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Ingen mulighed for at v\u00e6lge f\u00e6rre restriktioner for mindre skadelige produkter. S\u00e5 ikke alle fortalere for skadesreduktion er i stand til at besvare dette sp\u00f8rgsm\u00e5l.\u00a0<\/span><\/p>\n<p><b>Samlet set er hele 117 sp\u00f8rgsm\u00e5l ud af 201 i den retning og vil ikke f\u00f8re til et upartisk resultat af konsultationen.\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Dette adskiller sig fra den m\u00e5de, vi forventer, at Kommissionen skal engagere sig i offentligheden. Hele h\u00f8ringen efterlader os med det indtryk, at Kommissionen \u00f8nsker godkendelse af sin fjendtlighed over for skadesreducerende produkter. Vi h\u00e5ber, at de vil genoverveje denne tilgang, da lande som Storbritannien og Sverige beviser, at en \u00e5ben og forbrugervenlig politik over for alternative nikotinprodukter kan opn\u00e5 lavere rygerater. R\u00f8gfri m\u00e5l kan n\u00e5s, hvis regeringer l\u00e6rer af de bedste og mest effektive nationer. Lande med en relativt h\u00f8j adoption af alternative nikotinprodukter, s\u00e5som vaping, opvarmet tobak, nikotinposer og snus, er generelt i stand til at s\u00e6nke rygerater hurtigere end andre.
